Transaction Levy Amounts

Transaction Levies may need to be paid for real estate or civil litigation cases in Newfoundland & Labrador, Ontario, and Alberta.

CosmoLex pre-fills the levy amounts based on the province and levy type. This amount can be overwritten under Setup > Regional Settings.

Newfoundland & Labrador

HST is applied to transaction levy amounts in Newfoundland & Labrador.  Firms must submit HST directly to CRA rather than the Law Society.

Ontario

The Law Society of Ontario’s By-Law 6 determines the professional liability insurance requirements and fees.

The real estate transaction levy is $65.00 inclusive of taxes. There are circumstances under which a lawyer is exempt from a transaction levy, such as the transfer of land to a spouse.  

The civil litigation transactions levy is $100.00 inclusive of taxes for each civil litigation transaction for which the lawyer acted on behalf of a party. There are also circumstances under which a lawyer may be exempt from this levy.

Alberta

The Alberta Lawyers Indemnity Association (“ALIA”) has implemented the Civil Litigation Filing Levy (the “CLFL”). The terms of the CLFL are set out in the Transaction and Filing Levy Schedule.

The Civil Litigation Filing Levy involves charging a levy of $75 (plus GST) for commencing and responding to civil litigation (for example, filing statements of claim and originating notices [to the extent they launch an action]) in the Court of Queen’s Bench of Alberta. Filings that do not commence, or respond to an action are excluded.
